Introduction

  1. These Terms set out the legally binding terms which apply to everyone who accesses or uses the website at www.tennistykes.co.uk ("Website"). Please read the Terms carefully before using this Website. By accessing or using this Website, you agree to be bound by these Terms. If you do not wish to be bound by these Terms, you must leave this Website immediately.
  2. This Website is owned and operated by Tennis Tykes, Willow Cottage, Shaw Mills, Harrogate, HG3 3HU (07843342662) ("TT").

Your statutory rights

  1. Nothing in these Terms affects your statutory rights as a consumer, or excludes or limits our liability for fraud, or for death or personal injury resulting from our negligence, or for any other liability which we cannot exclude or limit under law.

You are permitted to display the materials on this Website on a computer screen and to download and print a hard copy of such materials strictly for your own personal use and provided you do not alter or remove any copyright, trade mark or other proprietary notices. You undertake not to:

a commercially exploit any materials on this Website without our express prior written consent;
b establish a link to this Website from any other website, intranet or extranet site, without our express prior written consent;
c use this Website to upload or distribute any material that contains viruses or anything similar;
d infringe the rights of any other person;
e do anything that will or may interfere with, disrupt, damage or impair this Website or our provision of services; and/or

  1. This Website is provided free of charge and we make no guarantee that it will be uninterrupted or error free. In addition, we reserve the right to modify or discontinue, temporarily or permanently, all or any part of this Website without notice and without liability.

B. Terms relating to the lessons

  1. a) Payment for the whole term of half term coaching course must be made at the time of booking.

b) All payments are non-refundable once the booking has been made. Therefore, refunds will not be given for any lessons which cannot be attended for whatever reason and/or if the child is subsequently withdrawn from the term’s coaching sessions.

c) Each weekly session begins promptly at the start time and therefore parents are asked to ensure that their child arrives by the specified time, suitably dressed in clothing to play sport and wears pumps or trainers.

d) Children should bring water in a bottle with them to each of the sessions.

e) Parents are required to attend the whole of each Tennis Tykes pre school session with their child.

f)  Any child attending the after school sessions should be collected promptly within no later than 5 minutes of the end of the session. Parents should provide details on the after school registration form of the person who will be collecting the child each week and if that person changes, they should notify Caroline Buncall or the coach prior to the session taking place.

g) We hope to maximise the enjoyment of every child at the Tennis Tykes sessions and therefore Tennis Tykes reserves the right to exclude any child from the sessions if they exhibit unruly or disruptive behaviour.

h) Tennis Tykes, its employees, servants and agents shall not be liable for any personal injury and/or loss or damage sustained to any participant, parent, carer or spectator or clothing or equipment other than that caused as a result of its negligence.

i) Photographs for promotional purposes may be taken during the sessions and used on the Tennis Tykes website and on printed material. If any parent would rather their child be omitted from any photographs taken, they should inform Tennis Tykes at the time of booking by either marking this on the registration form or by emailing caroline.buncall@tennistykes.co.uk.

k) From time to time, different venues to those advertised may need to be used. Tennis Tykes reserve the right to alter the venue if required and where possible the new venue will be situated within a similar area to the original venue.

l) By participating in the Tennis Tykes sessions you agree to:-

  1. keep confidential and to refrain from copying and/or using any features of the Tennis Tykes coaching programme and supporting material.

 

  1. refrain from managing, setting up or assisting in any similar or rival organisation without the prior consent of Tennis Tykes within a 50 mile radius.

                                                                       
m) We accept no responsibility for any personal property that is brought to ILTSC.
n) Price and availability information is subject to change without notice.
        o) We reserve the right to refuse admission should you breach any of these Terms.

 


C. Other Terms
Non-compliance with these Terms

  1. We reserve the right to investigate any suspected non-compliance with these Terms. If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may suspend or bar your access to this Website or take such other corrective action as we deem appropriate.


Limitations on TT’s liability to you

  1. We will use reasonable endeavours to ensure the accuracy of any information on this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be accurate, current, complete, or error-free. Unless we have been negligent, we accept no liability of any kind for any loss or damage arising from action taken in reliance on information on this Website.
  2. We will use reasonable endeavours to exclude computer viruses from this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be free from computer viruses introduced by third parties. Unless we have been negligent, we accept no liability of any kind for any loss or damage caused by computer viruses.
  3. Subject to paragraphs 3 ("Your statutory rights"), our liability (whether in contract, tort (including negligence), statute or otherwise) shall be limited to the price paid by you.
  4. Subject to paragraph 3 ("Your statutory rights"), we will not be liable to you for any:

    3. loss of anticipated savings;
    4. loss of business;
    5. loss of opportunity;
    6. loss of data;
    7. loss of or damage to goodwill or reputation; or
    8. any indirect or consequential loss or damage,

whether arising under contract, tort (including negligence), statute or otherwise.

Events outside our control

  1. We will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations that are caused by events outside our reasonable control.

ILTSC reserves the right to suspend or terminate any use by you of the Website, where it appears to ILTSC in its discretion that your use is in breach of these terms and conditions of use or any other terms and conditions on the Website.
